OVERVIEW 

These Terms and Conditions (“Conditions”) govern the supply of English sparkling wine and other website items (the “Products”) by Longdown Vineyard LLP (trading as Longdown) of Longdown House, Watley Lane, Twyford, Winchester, SO21 1QX (“we”, “our” or “us”), to customers for delivery within the United Kingdom (a “Customer” or “you”) via our website at www.longdownvineyard.com (the “Online Shop”).

The Customer agrees to be bound by these Conditions, which will be updated from time to time at our sole discretion. Permission to access or use the Online Shop is not granted to individuals who are not prepared to agree to be bound by these Conditions.

 IMPORTANT TO NOTE WHEN BUYING ALCOHOL:

  • AGE RESTRICTIONS – It is against the law in the Uk for any person under the age of 18 to buy or attempt to buy alcohol or for any person aged 18 or over to buy or attempt to buy alcohol for any person under the age of 18. By placing an order for Products via the Online Shop (“Order”), the Customer undertakes that he or she is at least 18 years old.
  • We are committed to upholding our legal and social obligations as a retailer of alcohol and will not sell or deliver to alcohol to anyone who is, or appears to be, under the age of 18. We reserve the right to refuse to accept an order at our sole discretion if we have reason to believe that the Customer is under 18 years of age, or if we have reason to believe that the Customer intends to supply alcohol purchased via the Online Shop to individuals under the age of 18.
  • If our couriers are in any doubt as to the age of the recipient of an Order, they will request some satisfactory form of ID and in the event they are not satisfied, they will be unable to complete delivery of the Order. Please see our delivery section below for further information. We reserve the right to validate the Customer’s name, address, age and other personal information supplied during the order process against appropriate third party databases for age verifications purposes and/or to request some suitable ID from the Customer to process the Order.

OUR PRODUCTS: 

  • We have made every effort to provide an accurate representation of the Products on the Online Shop. However, we do not warrant that the appearance or quality of any Product purchased by you will meet your expectations or be the same as depicted or rendered on the Online Shop.
  • All descriptions of the Products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any Product at any time and may limit the quantities of any Product that we offer to any person or geographical area on a case-by-case basis.

ORDERS: 

  • When you place an Order, you are making an offer to purchase. Longdown Vineyard reserves the right to accept or decline your Order for any reason at its sole discretion.
  • Your Order is not accepted until we confirm acceptance. We must receive and process your payment before your Order is accepted. Please review your Order carefully before submitting, as Longdown vineyard may be unable to accommodate cancellation requests after an Order is accepted. 
  • If we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the Order was made.
  • Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
  • You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

PRICES AND BILLING 

  • All prices for our Products are as shown on the Online Shop and are inclusive of UK VAT.
  • Although we endeavour to ensure that all pricing information shown on the Online Shop is accurate, occasionally an error may occur, and Products may be mis-priced in genuine error. If we discover such an error we will, at our discretion, either: contact you and ask you whether you wish to cancel your Order or continue with the Order at the correct price; or notify you that we have cancelled your Order. We will not be obliged to supply products at the incorrect price.
  • We reserve the right to change prices, discounts and promotions at any time without notice.
  • Prices posted on the Online Shop may differ from prices offered in physical stores or in online or other stores operated by third parties. 
  • We may offer, from time to time, promotions on the Products that may affect pricing and that are governed by terms and conditions separate from these Conditions. If there is a conflict between the terms for a promotion and these Conditions, the promotion terms will govern.
  • You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit/debit card numbers and expiration dates, so that we can complete your purchase and contact you as needed.
  • Full payment for Products purchased and any delivery charge is to be made at the time an Order is placed by credit or debit card or via Apple Pay. 
  • Title in the Products supplied to you will not pass until full payment has been made for the Products.

SHIPPING AND DELIVERY: 

  • We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer the Products to the carrier, title and risk of loss passes to you.
  • You are responsible for providing correct address details – we are not responsible for any mis deliveries as a result of incorrect postage information. 
  • We are not liable for any loss or damage suffered by you as a result of the courier carrying out delivery instructions given by you and the product being subsequently damaged, lost or stolen. 

THIRD-PARTY LINKS 

  • The Online Shop may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Online Shop to access these materials or third-party sites, you do so at your own risk. 
  • We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

RELATIONSHIP WITH SHOPIFY 

  • The Online Shop is powered by Shopify, which enables us to provide the Products to you. However, any sales and purchases you make on the Online Shop are made directly with Longdown Vineyard. By using the Online Shop, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Longdown Vineyard, including any injury, damage, or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Longdown Vineyard.

PRIVACY POLICY 

  • We will only use your personal information as set out in our Privacy Policy.

OUR LIABILITY 

  • We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the Products and for defective products under the Consumer Protection Act 1987.
  • The Online Shop is only intended for the sale of Products for domestic and private use. You agree that you will not use the Products for any commercial, business or re-sale purposes, and we shall have no liability in respect of any loss of profit, loss of business, business interruption or loss of business opportunity in any circumstances whatsoever.

COMPLAINTS: 

  • In the event of a complaint please contact Louise Papworth at louise@longdownvineyard.com. Complaints will be treated as confidential.

WEBSITE COUPON CODES: 

  • Coupon codes have no cash value and are not for sale. We reserve the right to withdraw or cancel coupon codes at any time.

GIFT VOUCHERS: 

  • Gift vouchers can be used towards the cost of wine or other website items. Gift vouchers cannot be redeemed for cash. If your purchase exceeds the value of the gift voucher, balance must be paid by cash debit or credit card. If your purchase value is less than the face value of the gift voucher redeemed, no change can be given. Gift vouchers are valid until the expiry date printed on them. In the event there is no expiry date expressed on them they will be valid for 12 months from date of purchase.

TERMINATION:

  • We may terminate this contract or your access to the Online Shop in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

DISCLAIMER OF WARRANTIES 

  • The information presented on or through the Online Shop is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials any Customer.

GENERAL: 

  • Both parties confirm their intent not to confer any rights on any third parties by virtue of the Contracts (Rights of Third Parties) Act 1999.
  • If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
  • Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Conditions, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

These Conditions are governed by English and Welsh law and the parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
